A SUMMARY OF ORDINANCE NO. 2026-2
Pursuant to Government Code Section 25124(b), the following constitutes a summary of Ordinance No. 2026-2 introduced for consideration by the Tehama County Flood Control and Water Conservation District Board of Directors.
The Ordinance establishes groundwater extraction administrative and project management action fees to support the Tehama County Flood Control and Water Conservation District’s responsibilities as the groundwater sustainability agency under the Sustainable Groundwater Management Act. It authorizes an annual Administrative Fee on parcels receiving extracted groundwater and a Project Management Action (PMA) Fee on parcels located within overdraft basins, with specific fee amounts to be established by future resolution of the Board of Directors.
The Ordinance describes the purposes of these regulatory fees, including administration, monitoring, reporting, enforcement, demand management, recharge efforts, dry-well mitigation, and related groundwater sustainability activities. It outlines potential allocation methods, provides exemptions for certain parcels such as public rights-of-way and qualifying de minimis users, establishes procedures for notice and public hearing before fee adoption, requires completion of the 2026 Well Registration Survey where applicable, and creates an administrative appeal process intended to support judicial review under Code of Civil Procedure section 1094.5.
